Evaluating the Relevance and Robustness of Nature Conservation Legislation

Abstract

As European Member States implement the EU Biodiversity Strategy targets of 30 % ‘protected’ and 10 % ‘strictly protected’ nature, political and legislative choices in defining these categories nationally will decide the outcomes for biotic integrity of a significant area of the European Union. The failure of many protected areas (PA) to prevent increased human pressures and degradation, and the widespread use of the PA label in areas under very superficial protection, including the many instances of legal downgrading, downsizing and degazettement of PAs (PADDD), reveal a nuanced reality of the role and character of legal protections in nature conservation. The seminar presents a model for evaluating the “strength” of Danish area-based nature conservation legislation in development as part of the Dansk Naturindikator (Danish Nature Indicator) project. The model and some preliminary results are discussed as alternatives to prior approaches to the classification of PAs and legal nature conservation measures.
